Terms and Conditions
Version: 1 October 2026. These terms govern the use of Bloomly and every order placed through it. Part A is the agreement between you and Bloomly e.U. as platform operator; Part B contains the uniform terms of sale that apply between you and the partner who sells your goods. This English version is a convenience translation; the German version is binding.
A1. Scope and operator
Bloomly is operated by Bloomly e.U., Landstraßer Hauptstraße 148a/2/20, 1030 Wien, Österreich, FN 685110 s, Handelsgericht Wien, VAT ID ATU83540223, e-mail office@bloomly.at ("Bloomly"). These terms apply to consumers who use Bloomly and order through it.
A2. Bloomly's role
Bloomly is an online marketplace. Goods are sold by independent partner businesses ("partners"). The purchase contract for a delivery is concluded between you and the partner named as seller for that delivery on the product page and during checkout. Bloomly is not a party to that contract; it brokers it, provides the platform, checkout, payment handling, messaging and support, and runs the review processes described below.
Exception: where a delivery names Bloomly e.U. itself as seller, Bloomly e.U. is your contracting party for that delivery and Part B applies to Bloomly e.U. as seller.
A3. Payment collection
Partners have authorised Bloomly to collect payments in their name (collection authority). Paying Bloomly discharges your debt to the partner. Payment is processed by our payment provider; refunds go back to the original payment method unless otherwise agreed or required by law.
A4. Help, complaints and Bloomly reviews
You can reach Bloomly through "Help" (signed in, or for guests through their order) and at the e-mail address above. Where a complaint is disputed or a cancellation request goes unanswered, Bloomly may review it: both sides can be asked for information, each in a private channel, and Bloomly decides with a reason both sides can read. This review does not limit your statutory rights, in particular your warranty rights and your right to go to court.
A5. Your account and your obligations
- Provide correct order, contact and delivery details.
- Keep your login secure.
- Do not use Bloomly abusively or fraudulently.
A6. Liability of Bloomly
Bloomly is liable under the mandatory statutory provisions for its own conduct as platform operator. The partner is responsible for its obligations as seller. Nothing in these terms excludes or limits liability where that would be unlawful.
A7. Changes
Bloomly may develop the platform further. Orders already placed remain subject to the terms that applied when they were placed.
A8. Applicable law and disputes
Austrian law applies, excluding its conflict-of-law rules. For consumers this choice applies only insofar as it does not deprive them of the mandatory protection of the law of their habitual residence. Bloomly is not obliged to take part in consumer arbitration proceedings and does so only where it expressly agrees in the individual case.
B1. Conclusion of the contract
Before you order, checkout shows each delivery's seller, the goods, the total price including VAT and delivery costs, and the delivery or pickup details. You can correct your entries until you press "Place order". Pressing it is a binding offer; the contract with the seller is concluded when your payment succeeds and you receive the order confirmation by e-mail.
B2. Prices, delivery and pickup
Prices include VAT where it applies. Delivery costs are shown separately before you order. The delivery or pickup date and window confirmed in your order apply. Please provide an address at which the goods can be delivered; for pickup, the partner's location and hours shown apply.
Goods with an age restriction (for example alcoholic drinks) are handed over only to adults after an age check. If the check fails for reasons on the recipient's side, the partner offers a new handover unless the recipient is under 18; otherwise the price of the goods is refunded, the delivery costs are not.
B3. Cancelling before fulfilment
The rules in this section are a voluntary cancellation option offered by the sellers. They are separate from the statutory right of withdrawal (B4), which remains unaffected. They apply per delivery, based on the goods in it — never on the kind of business that sells them — and the strictest item in a delivery decides. Personal add-ons do not decide it (see below).
Within 30 minutes of payment
Every delivery that can still be cancelled can be cancelled free of charge within 30 minutes of successful payment and is refunded in full, personal add-ons included.
Standard and perishable goods
For standard goods (for example boxed chocolates, candles, vases) and for perishable goods (for example fresh flowers, cakes) the free-cancellation period ends at the same time of day 2 of the partner's working days before the start of the confirmed delivery or pickup window (or 00:00 on a date-only delivery). Days on which the partner is closed, and public holidays, do not count; the period is therefore never shorter than 48 hours. Standard goods sent by post can be cancelled free of charge until they have been handed to the post.
Personalised or made-to-order goods
For personalised or made-to-order goods, the free-cancellation period ends at the deadline the partner states — at least 3 days before the start of the confirmed delivery or pickup window, at the same time of day, and never later than the period for perishable goods. A product may require a longer period. The period is fixed with the order and stays as it was, even if the partner changes it later.
Before the period ends
While the partner has not begun preparing, "Cancel order" cancels at once and free of charge. Once the partner has begun, you request the cancellation ("Request cancellation") so the partner can stop work; it stays free all the same. What counts is when you ask: a request made before the period ends is carried out free of charge — when the partner confirms it or, if the partner does not answer within 24 hours (at the latest by the end of the period), automatically.
After the period
After that you can "Request cancellation"; free cancellation is not guaranteed. The partner may agree to a free cancellation, offer cancellation for a stated cost up to the price — which only applies if you accept it within 30 minutes — or explain that it is no longer possible. Until a decision is made, the order goes ahead as planned. If the partner does not answer within 12 hours (at the latest by the start of fulfilment), Bloomly decides: free cancellation, or the order is carried out as ordered. If no decision has been made by the start of fulfilment, the order is carried out as ordered.
Personal add-ons
Add-ons that carry your words (for example a written card, a printed ribbon, an engraving or a photo) decide neither the kind of delivery nor how it is cancelled. For their own price the period for personalised goods applies: cancelled after it, they are not refunded; the other goods follow their own rules. For posted deliveries they have no period of their own; they are refunded with the delivery for as long as it can be cancelled.
Post and fulfilment already under way
Posted deliveries of perishable or personalised goods can only be requested for cancellation until they are dispatched. Once goods have been dispatched or handed over, they can no longer be cancelled through this order flow.
B4. Statutory right of withdrawal
Where the law grants you a right of withdrawal for distance contracts, it applies in addition to these rules; the details are in the information on withdrawal. There is no statutory right of withdrawal in particular for goods made to your specifications or clearly personalised, and for goods that can deteriorate or expire rapidly (§ 18 (1) 3 and 4 FAGG).
B5. Changing the date
Until the end of the free-cancellation period (B3; for standard goods sent by post, until dispatch) you can change the delivery or pickup time yourself once ("Change delivery time"): you are offered the times that are free for a new order with the same partner and location at that moment, and the new time applies at once. After that, or for a further change, you can "Request a change": the time you want is held for you and the partner decides within 12 hours (at the latest by the original time). If the partner declines or does not answer, your original time stays exactly as it was. The delivery or pickup method cannot be changed this way.
If the partner itself has to move your delivery, it offers you a new time. You can accept or decline it by the deadline stated with the offer (usually within 24 hours); if you decline or do not answer, the delivery is cancelled and refunded in full.
B6. Defects and complaints
Your statutory warranty rights apply. If a delivery is damaged, wrong, incomplete, late or did not arrive, report it on your order ("Report a problem"), ideally with photos. The partner answers within 2 working days; if it does not, or if you or the partner ask for it, Bloomly reviews the case. A voucher offered as a solution is always optional; you are never obliged to accept it instead of your statutory rights.
B7. Promo codes and vouchers
Promo codes and vouchers are subject to the conditions stated with them — validity, minimum order value, number of uses, participating partners. A voucher is not a refund of money; refunds go back to the original payment method.
