Information on withdrawal

Version: 1 October 2026. This English version is a convenience translation; the German version is binding.

Right of withdrawal

Where it is not excluded by law, you have the right to withdraw from a distance contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you other than the carrier, took possession of the goods; for several goods delivered separately, from the day the last of them was received. You can also withdraw before receiving the goods.

How to withdraw

Your contract is with the seller named for your delivery. Bloomly e.U. receives withdrawals on the sellers' behalf. The simplest way is the "Withdraw from contract" function on your order page (signed in, or as a guest through your order): select the goods, confirm with "Confirm withdrawal", and you receive a confirmation of its content, date and time by e-mail at once. You can also send us a clear statement, for example by e-mail to office@bloomly.at, or use the model form below; you do not have to use it.

To meet the deadline, it is enough to send your withdrawal before the period expires.

Effects of withdrawal

If you withdraw, all payments received from you for the goods concerned, including the standard delivery costs, are refunded without undue delay and at the latest within fourteen days of receiving your withdrawal, using the original means of payment unless expressly agreed otherwise; you are not charged any fees for this refund. The refund may be withheld until the goods have been received back or you have supplied proof of having sent them, whichever is earlier.

Please send the goods back without undue delay and at the latest within fourteen days of your withdrawal; the return details are shown in your order. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

No right of withdrawal

There is no right of withdrawal in particular for:

  • goods made to your specifications or clearly personalised (§ 18 (1) 3 FAGG) — for example a card with your message or a cake made to your design;
  • goods that can deteriorate or expire rapidly (§ 18 (1) 4 FAGG) — for example fresh cut flowers.

Whether an item is excluded depends on the item itself and is shown for each item during checkout. Your warranty rights are unaffected, and the voluntary cancellation rules in the Terms (B3) still apply before fulfilment.
